1. Introduction

Welcome to Nurture!

Nurture Holdings, Inc. ("Nurture," “we,” “us,” or “our”) is committed to a learning environment that respects and protects you and your child’s privacy. This Privacy Policy (“Privacy Policy” or this “Policy”) is intended to help you understand what information we collect, how we collect it, how we use it, with whom we may share it, and certain rights you have regarding the information we collect and hold about you and your child(ren). This Policy applies when you and your child access or use Nurture, our digital immersive learning platform, through the Nurture mobile app and Smart TV app (collectively the “App”), the nurture.is website (“Site”), any other websites and applications that link to this Policy (collectively, the “Platform”), as well as the services, features, functionality, content (e.g., characters, activities, games, and adventures) and tools we provide through the Platform (together with the Platform, collectively the “Services”), as well as when you contact us, use our social media pages, or otherwise interact with us and the Services (collectively, with the Platform and Services, “Nurture”).

Any capitalized terms used in this Policy but not otherwise defined are given the meaning set forth in our Terms of Service.

2. Scope

By accessing or using Nurture, you agree to the handling of your and your child’s information in accordance with this Policy. Using Nurture includes accessing the Platform, whether through the App or Site, joining the waitlist, trying Nurture Beta, registering for an Account and/or or purchasing a Subscription, communicating with us through the Platform or Services, responding to quizzes, surveys, or marketing emails or social media posts, signing up to receive our newsletter, accessing our social media pages, and any other uses of the Services.

By using the term “Personal Information” in this Privacy Policy, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Nurture users include “Child Users” (any child under age 13 who is using Nurture under their parents or legal guardians Account) and “Parent Users” (parents and legal guardians of Child Users), collectively, with any other individuals accessing or using Nurture, referred to in this Policy as “Users”.

We use the Personal Information of Users only in accordance with this Policy. If we need to use Personal Information for any other purpose, other than as disclosed in this Policy, we will seek consent at the time of collection and/or update this Policy, as explained below under Section 10 (Changes to Our Privacy Policy).

3. Country and State-Specific Terms

If you live in certain states or countries, you may have additional choices about our use and disclosure of your Personal Information or rights that apply to our processing of your Personal Information. Please see our Country/State Specific Rights Privacy Addendum located here for additional information regarding your rights under country/state specific data protection laws.

4. Information We Collect

We collect information, including Personal Information, directly from you when you provide such information to us about you and your child(ren), and automatically when you and your child(ren) use Nurture.

4.1 Information Users provide to us

We collect information that you provide directly to us, depending on your use of Nurture (e.g., joining the Nurture waitlist, signing up for our newsletter, using Nurture Beta, registering for an Account, purchasing a Subscription Plan, communicating with us, etc.) including:

  • Name

  • Email address

  • Phone number

  • Home Address

  • Date of birth

  • Payment Method information

  • Profile Data (username, password)

  • Posts and comments within the Nurturer community forum, comments on Nurture's blog posts, feedback, and survey responses

We also collect information that Parent Users provide directly to us on behalf of their Child User(s) including:

  • Username

  • Birthday

  • Personal interests, dietary preferences, other information you provide to Nurture about your Child User

Users registering individually must give their consent at the time of registration to provide us with their Personal Information (or if they are under 13 years of age, or legally a minor in their relevant location, a parent or legal guardian must consent on their behalf and provide the minor's personal information). A parent or legal guardian registering on behalf of their child(ren), must give their consent at the time of registration to provide us with information about them and their child(ren). Users may withdraw consent at any time by contacting us at [email protected].

We do not knowingly collect Personal Information from a Child User without a Parent User’s affirmative consent. If you believe we may have collected Personal Information from a child under 13 without parental consent, please contact us at [email protected].

4.2 Financial Transactions

Any processing of financial data, including payment processing, is carried out by third-party providers such as Stripe, the App Store, or Google Play. Nurture does not collect, store, or have access to any financial data. Your Personal Information is subject to the applicable terms of services and privacy policy of such third-party providers. Please review those terms and policies before submitting your Payment Method for processing by such third-party providers with respect to the purchases you make on Nurture through such third-parties.

4.3 Information we collect from Users

We and our third-party service providers automatically collect information, including Personal Information, from and about Nurture Users. Such information may include:

  • Device Information. Information about a User’s device(s) including IP address, log information, error messages, device type, and unique device identifiers.

  • Usage Data. Information that a User’s browser or device automatically sends to us when using Nurture, including pages and content viewed, the Services and features interacted with and actions taken, browser type, the dates and times of access, and computer/internet connection.

  • Location information. Information such as time zone setting and location, device motion information, other geolocation information.

  • Communication interaction data. Information from email providers, communication providers and social networks, such as a User’s interactions with our email or other communications (e.g., whether a User opens and/or forward emails), click-throughs, date/time stamps, and User’s preferences and consent in receiving electronic communications.

  • Session recordings. Recording a User’s sessions/chat bots when interacting with our Services.

  • Cookies/Tracking Technologies: Like must websites, mobile apps, and online services, cookies and other tracking technologies are used on Nurture. See the Cookies/Tracking Technologies section below for more information regarding how Cookies are used on Nurture to collect information from and about Users.

5. Cookies/Tracking Technologies

We use cookies and other tracking technologies on Nurture to recognize you and customize your and other Users’ experience. We and third-party companies may use these technologies whenever you visit our Platform or use our Services.

5.1 Cookies

A “cookie” is a piece of information sent to your browser by a website you visit. It lets the website remember what you do and any settings you choose (e.g., login information). Cookies make your experience more convenient and personalized.

Cookies set by us on Nurture are called "first party cookies". We may also allow our business partners and other third-party companies to set cookies on Nurture, which are called third-party cookies. Third-party cookies enable third party features or functionality to be provided on or through Nurture (e.g., like advertising, interactive content, and analytics). Such third-parties can recognize your device when it visits our Platform as well as when you visit other websites.

We use first party and third party cookies for several reasons. Some cookies are required for technical reasons in order for our Platform to operate and to provide you the Services you request, and we refer to these as "essential" cookies. Essential cookies are used to allow you to log in to Nurture and help the content of pages and activities you request load quickly.

Other non-essential cookies allow us to collect information regarding your interactions with the Platform and our Services to customize your experience and remember choices you make when you use our Services, such as remembering your login details. The purpose of these cookies is to provide you with a more personal experience and to avoid you having to reenter your preferences every time you visit our Services.

We may also use first party and third-party non-essential cookies to enable us to track and target the interests of our Users to enhance the Nurture experience. Third parties serve non-essential cookies through our Platform and Services for advertising, analytics, and other purposes. Such non-essential cookies are used to collect information about traffic to our Platform and how Users interact with our Services, such as the number of visitors to our Platform, the referring websites, the pages visited on our Services, and other similar information. Non-essential cookies are also used on Nurture to help us to promote and market our Services.

You have the right to decide whether to accept or reject cookies. You can set or amend your web browser controls to accept or refuse cookies. Each browser is different, so you should check your browser’s Help menu to learn how to change your cookie preferences. However, please note that if you reject or block cookies from the Services, the Services may not function as intended. For example, you will not be able to remain logged into your Account, and therefore, you would have to log in during each page transition.

5.2 Push Notifications and SMS

Additionally, if you downloaded the App on your mobile device to access Nurture, as part of your use of Nurture, we may ask if you would like to receive push notifications, which may include alerts and notifications, badges, banners, and sounds on your mobile device. You may choose to stop receiving push notifications at any time by changing the settings on your mobile device. If you provide us with your mobile phone number, we may send you SMS text messages about your Account. Please note that your carrier may charge you for the text messages you receive. To permanently stop receiving SMS text messages from us (if you are located in the U.S. or Canada) text STOP, CANCEL, or UNSUBSCRIBE in reply to any SMS text message sent by us.

5.3 Third-Party Tracking Technologies

We and our business partners may also use other technologies to track your use on our Platform and Services, such as called clear gifs (a.k.a. web beacons), pixels, session-replay technologies, and other third-party tracking technologies that help us better manage the Platform and Services by informing us what content is effective and to gauge the effectiveness of certain communications.

Nurture does not use third party cookies or tracking technologies to engage in behavioral targeting of advertisements to Child Users other than as specifically authorized by an Adult User.

6. How We Use Your Information

We and our third-party service providers use the information, including Personal Information, collected from Users as follows:

  • Operating and providing Nurture

  • Creating, administering, and managing your Accounts and Subscriptions

  • Measuring a Child User’s performance in activities and to adapt a Child User’s learning experience to the Child User’s learning needs.

  • Analyzing and providing progress reports on, or assessments of a Child User’s performance to the Adult User on the Account.

  • Managing purchases and payments

  • Personalizing and improving Nurture, our User experience, and our business

  • Communicating with you and for customer service-related purposes

  • Providing you with our newsletter, if you have registered and consented to receiving our newsletter.

  • Security purposes, including monitoring, risk assessment, addressing integrity and security issues related to Nurture, and fraud and crime prevention and detection.

  • Sending information that you request from us, including responding to inquiries or requests for information about or from us as well as sharing updates with you

  • Promotional, marketing, and advertising related purposes

  • Other business purposes, including, without limitation, administrative, planning, market, product, and service research and development, analytics, quality control, verifying your identity, investigating complaints, and dispute resolution

  • Complying with legal obligations, law enforcement, and legal processes, and to protect our rights, privacy, safety or property, and/or that of our Users, business partners, service providers, or other third parties

  • Otherwise as described and consented to at the time of collection

7. How We Share your Information

We share and disclose Users’ Personal Information, with the following third parties:

  • Affiliates, subsidiaries, business partners, and licensors to provide Nurture and for the purposes set out in this Privacy Policy.

  • Service providers who provide a variety of services on our behalf and in connection with Nurture, including, hosting, communications, development, administrative, and marketing. We contractually require our service providers to hold, use, and disclose your Personal Information in accordance with this Policy and applicable privacy laws and regulations.

  • Professional advisors, such as lawyers, auditors, bankers, and insurers, in the course of the professional services they render to us.

  • Law enforcement, in response to a subpoena or court order, or for other legal purposes such as to establish or exercise our legal rights, to assert or defend against legal claims, or if we believe such disclosure is necessary to investigate, prevent, or take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any User or other person.

  • Advertising networks and other providers to tailor advertising and offers presented to you based on your interactions with Nurture.

  • Third parties in connection with a merger, asset sale, financing, investment, liquidation, bankruptcy, or dissolution during the course of such transaction. In any such transactions, your personal information is a company asset.

Aggregated or De-identified Information. We also may disclose de-identified and/or aggregated User information for any other purpose as permissible by applicable law—provided that no individual User can be readily re-identified.

8. User Rights

We provide all Users with the following rights to manage the privacy of their Personal Information:

  • Updates. You may update your Personal Information and our collection thereof through your Account.

  • Corrections. You can edit and correct certain Personal Information at any time by changing it in your Account profile or contacting us as set forth below in the “Contact Us” section.

  • Access. You may request a copy of the Personal Information we have about you and your child(ren) by contacting us as set forth below in the “Contact Us” section.

  • Deletion. You may ask us to delete your Personal Information by contacting us as set forth below in the “Contact Us” section.

  • Cookies and other Tracking Technologies. You can manage browser cookies through your browser settings. The 'Help' feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to block cookies, and when cookies will expire. If you block all cookies on your browser, neither we nor third parties will transfer Cookies to your browser. If you do this, however, you may have to manually adjust some preferences every time you visit Nurture and some Services may not work.

  • Marketing Communication. To update your marketing communication preferences, you can go to your Account settings or contact us as set forth below in the “Contact Us” section. You may also unsubscribe using the link found at the bottom of all marketing and promotional emails.

9. Data Security/Retention

9.1 Security

We are committed to information security. We have implemented appropriate administrative, technical, and physical safeguards to protect the Personal Information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include encryption, access controls, and authentication measures. However, no physical or technological safeguards are 100 percent secure, and therefore we cannot guarantee the security of your Personal Information.

9.2 Retention

We retain Personal Information for as long as necessary to provide Nurture and fulfill the transactions you have requested or for other business purposes, such as complying with our legal obligations, resolving disputes, enforcing our agreements, and/or in accordance with our data retention policy. We decide how long we need Personal Information on a case-by-case basis, which means we may keep different information for different periods. Thereafter, we will destroy or de-identify and/or anonymize Personal Information.

10. Where We Process Information

Nurture is based in the United States and the Platform and our Services are controlled and operated by us and our third-party providers from the United States. We send information we collect from you to our secure services in the U.S. where we store and process it in accordance with this Policy. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using Nurture, you understand that your Personal Information will be transferred to our facilities in the United States and those third parties with whom we share such information, as described in this Privacy Policy; provided, that we will take reasonable steps to ensure that your privacy rights continue to be protected. If required by applicable laws, we rely on a valid international data transfer mechanism to enable cross-border data transfers.

11. Changes to Our Privacy Policy

From time to time, we may change or update our Privacy Policy. We reserve the right to make changes or updates at any time. If we make material changes that meaningfully impact the way we process your Personal Information, we will notify you by posting a notice on the Platform, by sending you an email, or by other means consistent with applicable law.

You can see when this Privacy Policy was last updated by checking the “Last Updated” date at the top of this Privacy Policy. Please review this Privacy Policy periodically to stay informed about how we protect the privacy of your and your child(ren)’s Personal Information.
